The intent is not to circumvent the distribution of controlled elements, but to enable a method for software to identify the difference between elements that should not be shared with elements that are clearly of an "amateur" nature. Obviously, anybody sharing elements that are provided under an agreement should be dealt with appropriately. A "standard" will not affect whether somebody inappropriately shares their data. The idea here is to come up with a standard (therefore consistent) way to determine elements that are appropriate to be shared from those that fall under an agreement.
